These terms govern the relationship between the customer who buys a workspace and its applications through FBS Platform (the "Customer") and the party providing the service. They are accepted at checkout.
1. The service
- The Customer uses its own workspace with the plan and applications it chose; the scope is stated in the order summary.
- The Customer sets and manages the terms offered to the users of its workspace (its own customers and staff).
2. Fees and payment
- Fees are the prices shown at checkout; taxes may apply separately.
- A subscription renews at the end of the chosen period unless cancelled. If payment is not made, the service may be suspended.
- Cancellation, plan change and refund rules are set out in the Subscription Cancellation and Refund Policy, which forms part of these terms.
3. Customer obligations
- To use the workspace lawfully and to make sure its users do the same.
- To collect its users' personal data lawfully and to obtain any required notices and consents on its own behalf.
- To protect its administrator accounts.
4. Applications that take payments or raise funds
If the Customer uses an application in its workspace that takes payments or raises funds, such as sales, donations, pre-sales, investment or lending:
- Payments are taken through the Customer's own payment service account; the party providing the service is not a party to transactions between the Customer and its users, backers or campaign owners.
- Reviewing and publishing campaigns, managing money held in escrow, making payouts and refunds, and verifying campaign owners and backers where needed are the Customer's responsibility; the application provides the tools for this.
- Permits, registrations and obligations required in the countries where the Customer is based and offers its service, in areas such as fundraising, payment services, investment and lending, anti-money laundering and sanctions, rest with the Customer.
- The default documents that come with the application (such as the campaign owner and backer agreements) are a starting template; the Customer reviews and adapts them to its own law and business model. These documents are not a substitute for legal advice.
- If an unlawful campaign or transaction comes to its attention, the party providing the service may suspend the feature concerned and, where necessary, cooperate with the competent authorities.
5. Data
Data in the workspace belongs to the Customer. Processing of personal data is governed separately by the Data Processing Agreement.
6. Continuity and support
We aim to provide the service with reasonable care and high availability; planned maintenance is announced in advance.
7. Termination
- The Customer may end its subscription at the end of a period.
- In case of a serious breach the service may be suspended or terminated.
- After termination the Customer may export its data within a reasonable period; the data is deleted afterwards.
8. Liability
To the extent the law allows, each party is liable only for direct losses, limited to the fees paid in the previous twelve months.
9. Changes
These terms may be updated; for important changes you will be asked to accept the new version.
