1. Parties and Acceptance
These Terms of Use ("Terms") govern the platform operated by FBS Inc. ("FBS Platform") and the solution modules offered on it. By creating an account or using the platform you accept these Terms.
2. Description of the Service
FBS Platform is a multi-tenant SaaS platform that delivers ready-made solution modules — donation management, customer support, sales and support over WhatsApp, prepaid card management, gift and prize-draw automation, project tracking and human resources — on one shared infrastructure. Each module can be purchased separately; your account keeps running on the same core infrastructure (user management, wallet, notifications).
3. Account Creation and Security
- You are responsible for the accuracy and currency of the information you provide when creating an account.
- You are responsible for keeping your account credentials (password, two-factor authentication) confidential.
- The account holder is responsible for every action taken through the account.
- You must contact us immediately if you notice suspicious access.
4. Subscription, Pricing and Billing
The platform and its solution modules may be offered as free tiers, fixed monthly paid tiers or transaction-based commission models. Amounts shown on the pricing page state clearly whether tax is included. Payments may be collected by credit or debit card, bank transfer, cryptocurrency or platform wallet balance. Unless stated otherwise, subscriptions renew automatically for the next period; cancellation is available from the admin panel until the end of the current period.
5. Purchasing and Cancelling Solution Modules
Each solution module can be enabled or disabled independently. Disabling a module does not delete its historical data; data is retained for the periods required by applicable law. Refund and withdrawal terms are stated separately on the order and payment screen of each module.
6. Rules of Use
You must avoid the following while using the platform:
- Producing content or transactions that are unlawful, fraudulent or that infringe third-party rights,
- Attempting to bypass the platform security measures or to gain unauthorised access,
- Sending automated or high-volume requests that disrupt normal operation of the system,
- Using another user account without permission.
Where such use is detected, the account may be suspended or terminated.
7. Intellectual Property
The platform software, design, trademarks and logos belong to FBS Platform or its licensors. These Terms grant a right to use the platform; they do not transfer any intellectual property right. Your own data and content remain yours; the platform processes them solely to provide the service.
8. Third-Party Services
Some functions — payment processing, e-mail and SMS notifications, hosting — run through third-party providers. Those providers own terms and privacy policies apply; beyond its duty of reasonable care, FBS Platform is not liable for interruptions in those third-party services.
9. Service Interruptions and Disclaimer of Warranty
The platform is provided "as is". No express or implied warranty is given that it will run uninterrupted or error-free; temporary interruptions may occur during maintenance, updates or events of force majeure. Planned maintenance is announced in advance wherever possible.
10. Limitation of Liability
To the maximum extent permitted by applicable law, FBS Platform is not liable for indirect damages, loss of profit or loss of data. Cases in which liability cannot be limited (intent, gross negligence, consumer rights and the like) fall outside this clause.
11. Termination
You may end these Terms at any time by closing your account. FBS Platform reserves the right to suspend or terminate your account on reasonable notice in the event of a material breach. After termination, data retention and deletion follow the periods stated in the Privacy Policy.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, USA. The courts of the State of Delaware have jurisdiction over disputes arising from these Terms.
